Terms of Service
Last updated: 4 October 2026
Version: 2.0
These terms apply to your use of Stashly at https://stashly.market, including the equestrian section at https://stashly.market/equestrian/listings, and our related emails, alerts and services.
Key points
This is a short summary. The full terms below are what apply.
- Stashly is an online marketplace and listings aggregator. Some listings are posted by our members and businesses. Others are collected from public sources such as Facebook groups, other websites and classifieds.
- We are not the seller. We are not the seller of any horse or item, and we are not a party to any sale, transport or other agreement between users. For member-posted adverts, the member is responsible for the advert and for what they sell.
- We do not check listings or sellers. We do not verify a horse's health, welfare, passport, microchip, ownership, transport or any payment. Always do your own checks before you buy.
- We are not linked to our sources. We are not affiliated with, endorsed by or sponsored by Facebook/Meta, Horsemart, HorseQuest, Whickr or any other source.
- Anyone can ask us to remove a listing, photo, name or phone number. Email hello@stashly.market. We acknowledge requests within 2 working days and act on valid requests within 7 days.
- Buyer Pro and Seller Pro are paid plans. Our current founder prices are Buyer Pro £1 a month or £9.60 a year, and Seller Pro £2 a month or £19.20 a year (section 20.1). They renew automatically until you cancel. You can cancel at any time in your account settings. Consumers have 14 days to cancel a new subscription.
- Claiming a business profile is free.
- Play fair. No scams, stolen horses, illegal sales or anything that harms animal welfare. No scraping or reselling our data.
- Your legal rights are protected. Nothing in these terms takes away your rights as a consumer under UK law.

These terms are a legal agreement between you and us. By using Stashly, you agree to them. When you create an account or buy a subscription, we will ask you to confirm this. If you do not agree, please do not use Stashly.

Where a section applies only to consumers or only to business users, we say so.

3. What Stashly is
3.1 Our role
Stashly is an online marketplace and listings aggregator. Some listings are posted by our members and businesses. Others are collected from public sources such as Facebook groups, other websites and classifieds. We are not the seller of any horse or item, and we are not a party to any sale, transport or other agreement between users. For member-posted adverts, the member is responsible for the advert and for what they sell.
Listings may show a title, photos, price, location, description, the Source it came from, and the Seller's contact details where these are available (see section 4.4).
3.2 What we do not do
We do not:
- sell horses, ponies, goods or services (other than our own Subscriptions);
- act as an agent for any buyer or Seller;
- handle payments between buyers and Sellers;
- inspect any horse or item; or
- verify Listings, Sellers, or a horse's health, welfare, temperament, age, height, breeding, passport, microchip, ownership, vetting history, transport or any payment.
Any agreement to buy, sell, loan, share, transport or provide livery for a horse is made directly between the people involved. Your rights and obligations under it are with the other party, not with us.
3.3 "Verified" badges
A "verified" badge on a Business Profile only means we have taken the steps in section 15.3 to check that the person who claimed it is connected with the business. It is not a recommendation or a check of quality, qualifications, insurance, licences or welfare standards.
4. Public-source listings
Our approach to public-source listings
- We only show information that was **publicly visible at the source**.
- We link back to the source and say where each listing came from.
- We keep personal data to what is needed to show the listing.
- We remove or hide listings that are sold or out of date, anything we are asked to remove (section 13), and we rotate listings off browse after about 90 days (3 months) from when we first published them on Stashly.
- If a source site or rights holder asks us to stop collecting from it, we promptly stop.
4.1 Where they come from
Public-Source Listings are collected from Sources where the advert was publicly visible. We show where each one came from and, where we can, link to the original advert. We show photos for the purpose of aggregation, with attribution and a link to the Source.
4.2 Accuracy
We take reasonable care when collecting and displaying Public-Source Listings. But the information was written by other people. It may be out of date (for example, the horse may already be sold), incomplete or wrong, and may have changed at the Source. It may even have been posted by someone not entitled to sell.
We do not promise that Public-Source Listings are accurate, complete or current. Always check the details with the Seller and at the original Source.
4.3 How long listings stay on browse
Listings we aggregate (including Public-Source Listings) usually stay on our browse feeds for up to about 90 days (3 months) from when we first published them on Stashly. We remove or hide them sooner if they appear sold or out of date, or if you ask us to remove them (section 13).
4.4 Contact details
Seller contact details from public sources are shown only where they were publicly visible at the source. We may limit them to Pro members, or hide them, at our discretion.
4.5 If it is your advert
If your advert appears on Stashly because it was public at a Source, you can:
- ask us to correct it, remove it, or remove your photos, name or phone number;
- ask us not to list your adverts in future; or
- where we offer it, claim the Listing so you can manage it. It then becomes a Member Advert and section 5 applies.
See section 13 (Takedown and removal).
4.6 Our stop-on-request commitment
If a Source, or the owner of rights in content at a Source, asks us to stop collecting from that Source, we will promptly stop collecting from it and deal with any existing Listings from it as set out in section 13.
5. Member adverts
5.1 Your responsibility
If you post a Member Advert, you are responsible for the advert and for what you sell. You promise that:
- the advert is accurate, honest and not misleading;
- for a horse, you own it or are authorised by the owner to sell, loan or share it;
- you have the right to use all photos and text in it;
- you will keep it up to date and mark it sold or remove it promptly when it is no longer available; and
- you will comply with the law, including animal welfare, horse identification and consumer protection law.
5.2 Business sellers
If you advertise as a business, you must make that clear in your advert, and you must comply with the consumer protection rules that apply to traders, including the Consumer Rights Act 2015 and the Digital Markets, Competition and Consumers Act 2024.
5.3 Paid and featured adverts
We may offer paid options for Member Adverts, such as featuring an advert or giving it stronger placement. Where we do:
- the price, what is included and how long it lasts will be shown before you pay;
- paid placement will be labelled "Featured" or otherwise made clear (section 18);
- paying does not change your responsibility for the advert, and we may still remove it if it breaks these terms; and
- if we remove a paid advert because it breaks these terms, we do not have to refund you, unless the law requires it.
5.4 Our rights over Member Adverts
We may edit Member Adverts for formatting (for example, to remove contact details posted in the wrong field), and may refuse, hide or remove them under section 12.
6. No affiliation with sources
Stashly is not affiliated with, endorsed by, or sponsored by Facebook, Meta Platforms, Inc., Horsemart, HorseQuest, Whickr or any other Source.
Their names and logos are trademarks of their owners. We use them only to say where a Listing came from. Messages you send through a "Messenger" or similar link are handled by that third party under its own terms.
7. Buying safely
7.1 Do your own checks
You are responsible for deciding whether a Listing, a Seller or a horse is right for you. Before you commit, we strongly recommend that you:
- see the horse in person, ideally more than once;
- arrange a pre-purchase vetting by an independent vet;
- check the horse passport matches the horse in front of you;
- scan the microchip and check it against the passport and the relevant equine database;
- check ownership and ask for proof, such as a receipt or bill of sale;
- check stolen horse registers and any freeze marks;
- get the deal in writing, including any promises about the horse; and
- arrange transport yourself with a reputable, properly authorised transporter.
7.2 Avoid scams
- Never pay a deposit or the full price to a Seller you have not verified, or for a horse you have not seen.
- Be wary of prices that seem too good to be true, or Sellers who will not let you visit or talk on the phone, or who pressure you to pay quickly.
- Do not pay by bank transfer to someone you do not know, or by gift cards, cryptocurrency or money transfer services.
- Never share bank logins, passcodes or card details.
- Be careful of "transport companies" or "agents" suggested by a Seller who want payment up front.
If you think you have been scammed, contact your bank straight away and report it to the police: in England, Wales and Northern Ireland through the national fraud reporting service (currently Action Fraud), and in Scotland to Police Scotland on 101. Please also report the Listing to us (section 12).
8. Your account
8.1 Creating an account
Some features, such as saved searches, alerts, messages and Subscriptions, need an account. You must give accurate information, keep your password secure and tell us promptly if you think someone else has used your account. Accounts are personal: do not create one for someone else or pretend to be someone else.
8.2 Closing your account
You can close your account at any time in your account settings or by emailing hello@stashly.market. Closing your account stops future Subscription renewals (see section 22). We delete account data within 30 days of closure, except where our Privacy Policy says we must keep it.
8.3 Inactive accounts
If you do not sign in for 3 years, we may close your account. We will email you before we do.
9. Saved searches, alerts and messages
9.1 Alerts
Members can save searches and track Listings, and choose to receive alerts in the Service, by email (including daily emails) and by SMS where offered. You can change or turn off alerts in your account settings, by using the unsubscribe link in any email, or by following the opt-out instructions in an SMS. Standard network charges may apply to SMS.
We do not promise that every matching Listing will trigger an alert, or that alerts will arrive at a particular time.
9.2 Contacting Sellers
We may offer ways to contact Sellers, such as our in-app chat, or links that open Facebook Messenger, SMS or a phone call. Third-party services have their own terms and privacy policies.
9.3 Message rules
You must not use messages to send spam or unwanted marketing, harass or threaten anyone, obtain money or personal details by deception, or break section 11. We may use automated tools to detect spam and scams in in-app messages, and may read messages that are reported to us, as explained in our Privacy Policy.
10. Licence for content you post
You keep ownership of Content you post. To run Stashly, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, adapt (for example, resize photos) and publish it in connection with the Service, including in search results, alerts, emails and posts promoting available Listings.
This licence ends when you delete the Content or your account, except for backup copies (overwritten within 35 days), Content we must keep for legal reasons or to deal with a report, and messages you have already sent.
You promise that you have the right to give us this licence.
11. Prohibited listings and acceptable use
11.1 Prohibited listings
You must not post, and we will remove, any Listing that:
- offers a stolen horse, stolen goods, or a horse you have no right to sell;
- is a scam, fake or "bait" advert;
- is an illegal sale, including selling a horse without the identification documents the law requires;
- breaches animal welfare law (such as the Animal Welfare Act 2006 and equivalent laws in Scotland and Northern Ireland) or harms an animal's welfare;
- offers prescription-only medicines, weapons or anything else banned from sale in the UK;
- is misleading about a horse's age, health, history, temperament or breeding;
- uses another person's photos, text or personal data without permission; or
- is a duplicate posted to manipulate search results.
11.2 Acceptable use
You must not:
- break the law, or post illegal, fraudulent, threatening, hateful, defamatory or infringing Content;
- pretend to be someone else, or misrepresent your link with a business;
- disrupt the Service or its security, upload harmful code, or access accounts or data you are not allowed to; or
- send spam, or collect other users' personal data for purposes these terms do not allow.
11.3 No scraping or reselling
Without our written permission, you must not:
- use bots, scrapers, crawlers or other automated means to access, copy or collect Content or data from Stashly;
- copy, sell, license or commercially use Listings, contact details or other data from Stashly;
- build a database or competing service using data from Stashly;
- get around access limits, such as Buyer Pro early access or contact details limited to Pro members; or
- share your account or Subscription with others.
Search engine indexing that follows our robots.txt file is allowed.
12. Reporting, moderation and illegal content
12.1 How to report
If you see a Listing, profile or message that you think is illegal, a scam, harmful to animal welfare or against these terms, use the "Report" link where it is shown, or email hello@stashly.market with a link and a short explanation.
If a crime is happening, or a person or animal is in immediate danger, contact the police or the relevant authority first (for example the RSPCA in England and Wales, the Scottish SPCA in Scotland, or the relevant council or authority in Northern Ireland).
12.2 What we do
We review reports and take appropriate action. This may include removing or hiding Content, asking the Seller for information, suspending an account, or reporting matters to the police or other authorities. We aim to deal with reports of illegal content swiftly, and will tell the person who reported it what we decided where appropriate.
12.3 Our moderation rights
We do not check all Content before it appears. But we may review, refuse, hide or remove any Content at any time if we reasonably believe it breaks these terms or the law, or puts people or animals at risk. We will act fairly and, where appropriate, tell you why.
12.4 Online Safety Act 2023
Member Adverts, Business Profiles and in-app messages may make Stashly a "user-to-user service" under the Online Safety Act 2023. We assess the risk of illegal content on Stashly, remove illegal content swiftly once we become aware of it, and provide easy ways to report content and to complain.
12.5 Appeals
If we remove your Content or restrict your account and you think we got it wrong, email hello@stashly.market within 28 days. Tell us what was affected and why you think the decision was wrong. A person who was not involved in the original decision, where possible, will review it, and we will tell you the outcome.
13. Takedown and removal
Anyone can use this process, whether or not they have a Stashly account.
13.1 What you can ask for
You can ask us to:
- remove or hide a Listing (for example, because the horse is sold, or you did not want it shown on Stashly);
- remove a photo;
- remove your name;
- remove your phone number or other contact details;
- correct information that is wrong; or
- stop listing your adverts in future.
13.2 How to ask
Email hello@stashly.market with "Removal request" in the subject line.
Please include:
- a link to the Listing (or enough detail for us to find it, such as the title, location and date);
- what you want removed, hidden or corrected;
- your connection to it (for example, "this is my horse", "this is my photo" or "this is my phone number"); and
- if you want us to stop listing your adverts in future, the name, profile name or phone number that appears in them, so we can recognise them.
13.3 Identity checks
We will not ask for identification unless we genuinely need it to verify your request. For example, we might need it if a request could harm someone else, or if two people disagree about who owns a Listing. If we do need it, we will ask only for what is necessary and use it only to deal with your request.
13.4 Our timelines
- We will acknowledge your request within 2 working days.
- We will act on valid requests within 7 days of receiving them (or of receiving any information we reasonably need).
13.5 What we do
For a valid request, we will:
- remove or hide the Listing, photo, name or phone number, as you asked;
- add the relevant details (for example, the advert, phone number or profile name) to our do-not-list record, so that the same content is not collected again; and
- confirm to you what we have done.
We use the do-not-list record only to stop the content reappearing. Our automated tools may not always recognise every advert, so please tell us if something gets through and we will remove it.
If we cannot act on a request, we will explain why.
13.6 Urgent cases
We prioritise urgent safety and privacy cases, such as Content that puts someone at risk of harm, exposes a home address or a child, or relates to a stolen horse or a scam. Mark your email "Urgent" and explain why. We aim to deal with urgent cases within 1 working day.
13.7 Copyright and other intellectual property notices
If you believe Content on Stashly infringes your copyright or other intellectual property rights, email hello@stashly.market with "IP notice" in the subject line. Please include:
- your name and contact details;
- a description of the work or right (for example, a photo you took);
- a link to the Content on Stashly;
- a statement that you believe in good faith that the use is not authorised by the owner or the law;
- a statement that the information in your notice is accurate and that you own the right or are authorised to act for the owner; and
- your name as a signature.
We will usually remove or hide the Content while we look into it. For a Member Advert, we will normally tell the Member and may give them a copy or summary of the notice, including your name, so they can respond. Do not send false notices: you may be legally responsible if you knowingly make a false claim.
13.8 Counter-notices
If your Content was removed after an IP notice and you believe this was a mistake, email hello@stashly.market with "Counter-notice" in the subject line. Include your name and contact details, the Content that was removed, why you believe the removal was wrong or why you have the right to use it, and a statement that your counter-notice is accurate.
We may share it with the person who sent the notice. We may restore the Content if we are satisfied it does not infringe, unless they tell us they have started legal proceedings. We cannot decide legal disputes between you and them.
13.9 Repeat issues
We may suspend or close the accounts of Members who repeatedly post infringing or prohibited Content, or who repeatedly send false notices. We may stop collecting from a Source, group or account that repeatedly causes valid complaints.
13.10 If you disagree with our decision
If you are unhappy with how we dealt with a removal request, IP notice or counter-notice, reply to our email explaining why. We will review the decision and reply within 14 days. If you are still unhappy, you can use our complaints process (section 28). For personal data, you can also complain to the Information Commissioner's Office (see our Privacy Policy).
13.11 Records
We keep a record of each request, what we decided and what we did. We keep these records for 6 years so we can show how we handled requests and deal with any later questions or disputes.
13.12 Your data protection rights
If the information is about you, you also have rights under UK data protection law, including the right to object and the right to erasure. We treat a removal request as an objection and, where appropriate, an erasure request. We will always respond within the legal time limit of one month. Our Privacy Policy explains these rights.
13.13 The original advert
Removing a Listing from Stashly does not remove it from the original Source. To remove it there, contact that website or group.
14. Intellectual property
We, or our licensors, own the intellectual property in the Service, including our software, design, logos, the text we write, the way we organise and compile Listings, and our databases. "Stashly" and the Stashly logo are our trademarks.
You may use the Service for its intended purpose in line with these terms. You must not copy or reuse any part of it except as these terms allow. Public-Source Listings and Member Adverts belong to their owners and are displayed as described in sections 4, 5 and 10. For copyright complaints, see section 13.7.
15. Business profiles and claiming
15.1 What a Business Profile is
We may create Business Profiles for equestrian businesses using publicly available information. Businesses can also create their own.
15.2 Claiming is free
A business can claim its Business Profile free of charge to check and update its details, respond to enquiries and manage how it appears. You do not need Seller Pro to claim a profile.
15.3 Verification
You must own the business or be authorised to act for it. We may ask you to verify this, for example by confirming a code sent to the business's listed phone number or email, showing control of its website or social media page, or giving other reasonable evidence. We may refuse or reverse a claim if we reasonably believe it is not genuine. If two people claim the same business, we may ask both for evidence.
15.4 Your responsibilities
Once you claim a profile, you are responsible for keeping it accurate and lawful, including prices, vacancies, facilities, qualifications and any claims about insurance or accreditation. When you claim a profile, you use Stashly as a business user, and the business-user parts of these terms apply to you.
15.5 Removing a profile
If you do not want a profile on Stashly, ask us to remove it under section 13. A sole trader's business details may also be personal data (see our Privacy Policy).
16. Seller Pro
16.1 What it includes
Seller Pro is a paid Subscription for business users. Depending on the plan, it may include vacancy control, facilities information, an enquiry inbox, stronger placement (section 18), instant lead alerts (section 17) and simple insights, such as profile views.
16.2 Price
Seller Pro currently costs £2 a month or £19.20 a year (our founder prices, see section 20.1). The price you pay is the one shown on the Pro page at the time you subscribe.
16.3 Business use
Seller Pro is sold to businesses, so the consumer cancellation rights in section 21 do not apply. We do not promise any particular number of views, enquiries, Leads, bookings or sales.
17. Leads and instant lead alerts
17.1 What a Lead is
A Lead is an enquiry or request for a service that we match to your business. Leads may come from enquiries made by Members on Stashly, or from public posts at Sources where someone asks for a service (for example, "Looking for a farrier near Hereford").
17.2 Instant lead alerts
With Seller Pro, we may tell you when someone nearby asks for a service you offer. Matching is automated, using things like the type of service, location and the words in the post. It may not be perfect.
17.3 Your responsibilities
When you contact a Lead, you must:
- only contact the person about the service they asked for;
- be honest about who you are and how you found their request;
- not add them to marketing lists without their consent;
- stop if they ask you to; and
- comply with UK data protection law and the Privacy and Electronic Communications Regulations 2003.
You will usually be a separate controller of any personal data you receive through a Lead. We do not promise that a Lead is genuine, still current or will result in work.
18. Featured and paid adverts, and ranking
18.1 Featured placement
Some Listings or Business Profiles appear more prominently because the business or Member has paid for it. These are clearly labelled "Featured", or the paid placement is otherwise made clear.
18.2 How we rank results
By default, we rank results by how well they match your search and filters, distance, how recently they were posted or updated, how complete they are, and whether a paid plan or paid option includes stronger placement. You can usually sort by other options, such as newest, price or distance. We do not rank paid Listings higher without making that clear.
19. Buyer Pro
19.1 What it includes
Buyer Pro is a paid Subscription for buyers. New listings may be available to Buyer Pro members before they are shown to everyone else. The length of the early-access period is shown on the Pro page. Some Seller contact details may also be limited to Pro members (section 4.4).
19.2 Price
Buyer Pro currently costs £1 a month or £9.60 a year (our founder prices, see section 20.1). The price you pay is the one shown on the Pro page at the time you subscribe.
19.3 What early access does not mean
Early access means you may see Listings sooner. It does not mean you will be able to buy any particular horse, that Listings are verified, or that Sellers will reply. Section 7 applies to everything you see on Stashly.
20. Prices, payments and renewals
20.1 Current prices (founder prices)
Stashly has just launched. These are our founder prices:
| Plan | Monthly | Yearly |
|---|---|---|
| Buyer Pro | £1 a month | £9.60 a year (works out at £0.80 a month, 20% less than paying monthly) |
| Seller Pro | £2 a month | £19.20 a year (works out at £1.60 a month, 20% less than paying monthly) |
Our current prices are always shown on the Pro page. Prices are shown inclusive of VAT where VAT applies. The price you pay is the one shown on the Pro page at the time you subscribe, and you will see it again at checkout before you pay.
20.2 Future prices and price changes
Our prices may change in future. In particular:
- founder prices may not be available to new subscribers later. If we change them, new subscribers will pay the price shown on the Pro page when they subscribe;
- we do not promise to keep your price the same for ever, unless the Pro page or your checkout clearly says that a price is fixed for a stated period;
- if we change the price of your existing Subscription, we will email you at least 30 days before the new price applies to you;
- the new price will only apply from your next renewal after that notice period; and
- you can cancel before the new price takes effect, and you will not be charged the new price.
20.3 How you pay
We use Stripe to process payments. Your card details go directly to Stripe. We do not see or store your full card number. Stripe's own terms and privacy policy also apply.
20.4 Before you buy
Before you buy a Subscription, we will clearly show you:
- the price and how often you will be charged;
- that the Subscription renews automatically until you cancel;
- any free trial or introductory price, how long it lasts and what you will pay afterwards; and
- how to cancel.
Monthly plans have no minimum term.
20.5 Automatic renewal
Subscriptions renew automatically at the end of each billing period, and we will charge your payment method unless you cancel before the renewal date.
20.6 Reminders
We will email you:
- at least 7 days before any free trial or introductory offer ends;
- at least 14 days before each annual renewal; and
- at any other times the law requires.
Each reminder will say when the next payment is due, how much it is and how to cancel.
20.7 New subscription law
When the subscription contract rules in the Digital Markets, Competition and Consumers Act 2024 come into force, we will comply with them. These include clear information before you sign up, reminder notices, a cooling-off period on some renewals, and an easy way to cancel. We will update these terms to reflect them.
20.8 Failed payments
If a payment fails, we will tell you and may try again. If we still cannot take payment, we may pause or end your Subscription. Business users will receive VAT invoices where VAT applies.
21. Your right to cancel (consumers)
This section applies to consumers only.
21.1 Your 14-day right
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a new Subscription within 14 days of the day you buy it, without giving a reason.
21.2 Starting straight away
Buyer Pro gives you access straight away. At checkout, we will ask you to tick a box (it will not be ticked already) to:
- expressly request that your access starts during the 14-day cancellation period; and
- acknowledge that, if you then cancel within the 14 days, you will pay for the access you have had up to the point you cancel.
We will confirm this in your order confirmation email. If you do not tick the box, your access will start when the 14-day period ends.
21.3 Your refund
If you cancel within 14 days:
- if your access had not started, we will refund everything you paid; or
- if you asked for access to start straight away, we will refund what you paid, minus a proportionate amount for the days you had access.
We will refund you within 14 days of being told you have cancelled, using the payment method you used.
21.4 How to cancel
Tell us clearly that you want to cancel. You can cancel in your account settings, email hello@stashly.market, or use the form in Appendix A (you do not have to). You only need to send your message before the 14 days end.
22. Ending a subscription and refunds
22.1 Cancel at any time
You can cancel a Subscription at any time in your account settings, or by emailing hello@stashly.market with "Cancel subscription" in the subject line. Cancelling will be as easy as signing up. We will confirm by email.
22.2 What happens next
After the 14-day period, if you cancel you will not be charged again. Your Subscription stays active until the end of the period you have paid for, then your account moves to the free version.
22.3 Refunds
Apart from section 21 and your legal rights, we do not normally refund part of a billing period. We may give a full or partial refund if the Service was unavailable for a significant time because of a problem on our side, was not as described, or was not provided with reasonable care and skill. This does not affect your rights under the Consumer Rights Act 2015 (section 26).
22.4 If we end your Subscription
If we end your Subscription without a good reason under section 23, we will refund any period you have paid for but not received.
23. Suspension and termination
23.1 When we may act
We may suspend or close your account, remove your Content or end your Subscription if:
- you seriously or repeatedly break these terms;
- you post a prohibited Listing or illegal Content;
- we reasonably suspect fraud, scams or other misuse;
- the law, a regulator, court or the police require us to; or
- your account puts other people, animals or the Service at risk.
23.2 Notice
Where reasonable, we will tell you first and give you a chance to explain or fix the problem. We may act immediately where there is a serious risk or legal requirement, or where telling you could harm an investigation. You can appeal under section 12.5.
23.3 If we stop the Service
We may stop providing the Service, or part of it, with at least 30 days' notice. We will refund any amount you have paid for a period after it ends.
23.4 What continues
Sections that by their nature should continue after your account ends (such as sections 14 and 26 to 32) will continue to apply.
24. Availability and changes to the service
We aim to keep Stashly available and working well, but we cannot promise it will always be uninterrupted or error-free. We may suspend it for maintenance or for reasons outside our control, and will try to give notice of planned maintenance.
We may change, add or remove features. If a change significantly and negatively affects a paid Subscription, we will tell you in advance and you may cancel and get a refund for any period paid for but not received.
25. Third-party links and services
Stashly links to other websites and services, including original Source adverts, Facebook and Messenger, Seller websites and Stripe. We do not control them and are not responsible for their content, availability, terms or privacy practices. A link does not mean we endorse them.
26. Our responsibility to consumers
This section applies if you are a consumer.
26.1 Your legal rights
We must provide our paid Subscriptions with reasonable care and skill, and any digital content must be of satisfactory quality, fit for purpose and as described, as the Consumer Rights Act 2015 requires. If we do not, you may be entitled to a repeat performance, repair, replacement, price reduction or refund. For more about your rights, contact Citizens Advice (or Advice Direct Scotland in Scotland, or Consumerline in Northern Ireland). Nothing in these terms affects your legal rights.
26.2 What we are responsible for
If we break these terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss or damage is foreseeable if it is obvious it will happen, or if both of us knew it might happen when you accepted these terms.
26.3 What we are not responsible for
We are not responsible for:
- deals between users, including the condition, health, welfare, ownership or description of any horse or item, or any payment, deposit or transport;
- the accuracy of Listings, which are written by other people (although we will act on reports and removal requests);
- the acts of Sellers, other Members or third parties, including scams;
- third-party websites and services we link to; or
- events outside our reasonable control, such as internet or power failures or cyber attacks. If such an event affects a Subscription, we will tell you and try to limit its effect.
We still use reasonable care in providing the free parts of Stashly.
26.4 Business losses
If you use Stashly as a consumer, we are not responsible for any loss of profit, loss of business, business interruption or loss of business opportunity.
26.5 What we never limit
We do not exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, breach of your legal rights as a consumer that cannot be excluded, or anything else that cannot be excluded or limited under UK law.
27. Our responsibility to business users
This section applies if you are a business user, including when you claim a Business Profile, contact Leads, post adverts as a business or buy Seller Pro.
27.1 What we never limit
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or anything else that cannot be limited or excluded under UK law.
27.2 Exclusions
Subject to section 27.1, we are not liable to business users, whether in contract, tort (including negligence) or otherwise, for:
- loss of profits, sales, business, revenue or anticipated savings;
- loss of business opportunity, goodwill or reputation;
- any indirect or consequential loss; or
- any loss caused by Leads, Listings, Members or third parties.
27.3 Limit
Subject to section 27.1, our total liability to a business user in any 12-month period is limited to the greater of the fees you paid us in that period and £100.
27.4 Your promise to us
If you are a business user, you will compensate us for reasonable losses, costs and expenses (including reasonable legal fees) we suffer because of a third-party claim arising from your Content, your breach of these terms, or your misuse of personal data received through Stashly. We will tell you promptly about any such claim and let you help defend it.
28. Complaints and disputes
28.1 How to complain
Please contact us first by emailing hello@stashly.market with "Complaint" in the subject line, or by post to our registered office (section 1). Tell us your name, your account email (if you have one), what went wrong and what you would like us to do.
28.2 What happens next
We will acknowledge your complaint within 5 working days and send a full response within 28 days. If we need longer, we will tell you why and when to expect a reply.
28.3 If you are still unhappy
We do not currently use an alternative dispute resolution (ADR) provider. If you are a consumer and our response does not resolve your complaint, you can:
- get free advice from Citizens Advice (or Advice Direct Scotland, or Consumerline in Northern Ireland);
- use an ADR provider, if we both agree to; or
- bring a claim in the courts (section 32).
For complaints about personal data, see our Privacy Policy, which explains how to complain to the Information Commissioner's Office.
29. Changes to these terms
We may change these terms, for example to reflect changes in the law, new features or how we run the Service.
- For minor changes (such as fixing typos), we will update the "Last updated" date.
- For material changes, we will tell you by email or a notice on Stashly at least 30 days before they take effect, unless we must act sooner for legal, safety or security reasons.
If you do not agree, you can close your account before the change takes effect. If you have a Subscription, you can cancel it and we will refund any period paid for but not received after the change. Previous versions are available on request.
30. If Stashly is transferred
In future, Stashly may be transferred to another company in our group or to another organisation, for example if the business is reorganised or sold. If that happens:
- we may transfer this agreement, and your account and Subscription, to the new operator;
- we will tell you who the new operator is;
- we will give you at least 30 days' notice of any material changes to these terms as a result;
- the transfer will not reduce your rights under these terms or the law; and
- your privacy rights will continue, as explained in our Privacy Policy.
You can close your account or cancel your Subscription if you do not want to continue with the new operator.
You need our written permission to transfer your rights or obligations under these terms.
31. General legal terms
31.1 Entire agreement
These terms (with any extra terms you accept when buying a Subscription or paid advert) are the whole agreement between you and us about the Service. If you are a business user, you agree that you have not relied on any statement or promise not set out in these terms. This does not limit liability for fraudulent misrepresentation.
31.2 Severability
Each section works separately. If a court decides any part is unlawful or unenforceable, the rest stays in force.
31.3 Third parties
Only you and we can enforce these terms. No one else has any right to enforce them under the Contracts (Rights of Third Parties) Act 1999.
31.4 No waiver
If we do not insist straight away that you do something, or delay taking action, we can still do so later.
32. Governing law and courts
32.1 Consumers
These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales.
If you live in Scotland, you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring them in either the Northern Irish or the English courts. Nothing in this section takes away mandatory consumer protections given by the law where you live.
32.2 Business users
If you are a business user, these terms and any dispute or claim (including non-contractual ones) are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
